Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Client") and Limited Liability Company "PF-TECHNOLOGY-INT" (Address: Republic of Uzbekistan, Jizzakh region, Jizzakh city, Sayiljoyi MSG, Sharof Rashidov street, building 5, TIN 309920193) governing your access to the TechCertify platform at: techcertify.pro ("Platform").

By registering an account, accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

2. Definitions

Platform: The TechCertify online platform for recruiting and assessing candidates, including all software, databases, interfaces, content, and related services.

Subscription: A paid access plan granting Users the right to use specific Platform features for a set period.

Candidate Database: Structured candidate information containing professional details, interview records, skills assessments, and other data.

Candidate Contact Information: Candidate contact details (phone numbers, email addresses, messenger accounts) that become available only with the candidate's consent.

Pre-offer: A preliminary employment offer sent by the User to a candidate through the Platform's functionality.

3. Right to Use and Registration

To use the Platform, you must:

• Be at least 18 years old;
• Have the legal capacity to enter into contracts;
• Provide accurate, current, and complete registration information;
• Ensure the security of your account credentials.

You agree to:

• Promptly update registration information if it changes;
• Not share your account credentials with third parties;
• Immediately notify us of any unauthorized access to your account.

We reserve the right to refuse service, terminate accounts, or cancel subscriptions in cases established by the offer to use the Platform.

4. Subscription and Payment Terms

We offer various subscription plans with different features, terms, and prices. Current plans are displayed on the Platform.

All payments must be made in advance through our integrated payment processing system. We accept payments via credit/debit cards and other payment methods available in Uzbekistan.

We may change subscription prices at any time. Price changes do not affect current subscription periods but apply to subsequent renewals.

5. Platform Usage Rights

Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform during your subscription period.

You have the right to use the Platform to:

• Search and view candidate profiles;
• Assess candidate qualifications;
• Send pre-offers to candidates;
• Communicate with candidates who have consented to it;
• Manage recruitment processes.

You must not:

• Copy, modify, or create derivative works of the Platform;
• Decompile or disassemble any part of the Platform;
• Use the Platform to develop a competing service;
• Use automated means to access the Platform (scraping, crawling);
• Share your account or subscription with third parties;
• Use the Platform for illegal or unauthorized purposes.

6. Candidate Data and Privacy

All candidate data is provided with appropriate consent in accordance with the Law of the Republic of Uzbekistan "On Personal Data".

Candidate contact information becomes available only after the candidate explicitly accepts a pre-offer through the Platform.

You agree to use candidate data solely for recruitment purposes, and not for marketing, spam, or any unauthorized purposes.

You must comply with all applicable data protection laws when using candidate information obtained through the Platform.

7. Intellectual Property

We retain all exclusive and other rights regarding the Platform.

"TechCertify" and associated logos are trademarks owned by us. You may not use them without our prior written permission.

8. Disclaimer of Warranties and Limitation of Liability

We strive to maintain Platform availability but do not guarantee uninterrupted, error-free operation.

We do not verify all information provided by candidates. You are responsible for conducting your own background checks before making hiring decisions.

The Platform is provided "as is" and "as available" without any warranties of any kind, express or implied.

To the maximum extent permitted by law, our total liability to you for any claims arising out of these Terms or the use of the Platform shall not exceed the amount you paid us in the six months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

9. Termination

You may terminate your subscription at any time by canceling automatic renewal. Refunds for unused portions of paid periods are not provided unless otherwise agreed by the parties.

We may suspend or terminate your access to the Platform immediately if you violate these Terms.

Upon termination, your right to use the Platform ceases immediately. We may delete your account data.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Uzbekistan.

Any disputes arising from these Terms must first be attempted to be resolved through good faith negotiations. If the dispute is not resolved pre-trial, it shall be submitted to the court of the city of Tashkent, Uzbekistan.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through a notice on the platform at least 1 day before they become effective.

Your continued use of the Platform after the changes take effect constitutes acceptance of the modified Terms.
